Democratic lawmakers are demanding that the Occupational Safety and Health Administration withdraw proposed rules that would reduce respirator mask requirements for workers exposed to hazardous substances. The group argues the changes would weaken protections against dangerous chemicals in the workplace.

The letter to Osha assistant secretary David Keeling cites a statistic from the agency's own context: more than 5,000 Americans die annually from occupation-related respiratory illnesses. The lawmakers point to rising rates of silicosis and coal-related worker’s pneumoconiosis, partly due to artificial stone used for countertops and increased silica exposure in coal seams.

Under the proposal, employers would face fewer mandates to provide respirators when workers handle lead, asbestos, formaldehyde, and inorganic arsenic. The rules would also eliminate the requirement for employers to provide medical evaluations to employees who wear specific types of respirators. Keeling, a former executive at UPS and Amazon, received the correspondence on October 29, 2026.

The criticism targets the pace of the rulemaking process. Osha issued the proposed rules in July 2025 without providing required evidence or requesting information needed for implementation. A procedural hearing took place in August during the congressional recess, leaving no lawmakers on Capitol Hill to discuss the changes. The signatories noted that most Osha standards take years to develop, whereas these respirator rules moved through the process in months.

The letter was signed by Senators Elizabeth Warren, Chris Van Hollen, and Cory Booker, along with Representatives Ilhan Omar, Pramila Jayapal, Rashida Tlaib, and Jasmine Crockett. More than 20 other congressional Democrats added their names. The lawmakers stated that the Department of Labor is prioritizing the interests of unscrupulous employers over workers.

External groups support the lawmakers' stance. Unions and experts from the Advisory Committee on Construction Safety and Health, the American Industrial Hygiene Association, and National Nurses United have warned against pulling back standards. The Associated General Contractors of America also opposed the rules, stating that quality safety regulations save contractors money and that deregulatory benefits would be outweighed by potential liability.

The rollback is part of a wider deregulatory effort at Osha under the Trump administration, which proposed more than 60 deregulatory rule changes in the Department of Labor last year. In 2025, Osha inspections dropped by 20% and the agency lost 223 full-time employees to buyouts and early retirements. Republicans have proposed cutting Osha’s budget by over 8% for fiscal year 2027. Osha did not immediately respond to a request for comment.
